LFN Withdraws Amicus in Expropriation Case – DA Minister Pushes Costs

What should have been a concluded matter has now escalated into a direct confrontation with the Democratic Alliance’s Minister Dean McPherson. LFN maintains that a lawfully withdrawn application cannot be resurrected through political insistence or procedural pressure.

This appearance is bigger than one case.

It is a public test of whether the Democratic Alliance still upholds constitutional principle — or whether it has become indistinguishable from the governance conduct it once opposed.

Let me speak plainly.

LFN withdrew its Amicus Curiae application in the Expropriation Act challenge. Yes — we withdrew.

But not because we were wrong.
Not because we were intimidated.
And definitely not because the Expropriation Act doesn’t matter.

We withdrew because the legal team of the Democratic Alliance’s Minister of Public Works and Ifrastructure, Mr Dean McPherson, turned what should have been a focused constitutional battle into a procedural circus.

After the Case Management Hearing on 28 January 2026, opposition was suddenly introduced — despite it being indicated on record by the Minister’s senior counsel, Mr Anton Katz, that there was none.

No condonation.
Non-compliant filings.
Irregular steps.

And what would that mean?

More Rule 30 irregular step fights.
More technical objections.
More delays.

And who suffers?

The main Expropriation Act challenge.

That’s the case that matters.

So we made a decision:

We are not going to derail a constitutional property rights battle over procedural defects.

We stepped aside to protect the bigger fight.


And Now? The DA Minister Wants Costs.

The matter was lawfully withdrawn.
It is no longer live before court.

Yet the Minister of Public Works and Infrastructure — yet another Democratic Alliance Minister like his leader John Steenhuisen being in the news for all the wrong reasons — now insists on pushing a costs hearing. And yes, everyone who wants to attend is most welcome to do so.

Let’s Be Honest About the Politics

This is the Expropriation Act challenge.

The DA positions itself publicly as the defender of property rights.

At the same time, its Minister’s legal team:

• Introduced opposition late.
• Failed to regularise defects.
• Created procedural escalation.
• And now seeks costs against a voluntary civic body.

We challenge the ANC.
We challenge the DA.
We challenge anyone when constitutional principles are at stake.

And yes — the DA challenges LFN just as aggressively.

That’s public record.

But here’s the real issue:

Why is a taxpayer-funded State Attorney’s office being used to pursue costs against a public-interest organisation that withdrew to prevent delays?
