The Liberty Fighters Network (LFN), under the leadership of its President, Reyno De Beer, has today filed a fresh landmark application in the Gauteng High Court, Pretoria, against the Minister of Cooperative Governance and Traditional Affairs, Mr. Velenkosini Hlabisa.
This case builds on LFN’s well-known role in challenging South Africa’s COVID-19 lockdown. On 2 June 2020, the Pretoria High Court (Justice Norman Davis) declared the Disaster Management Act (DMA) Regulations unconstitutional — a judgment that shook the nation. Although this ruling was later overturned by the Supreme Court of Appeal (SCA) under what LFN describes as “extremely questionable circumstances”, the fight did not end there.
The New Application
LFN has reorganised its legal position and now advances a new argument never before adjudicated. At its centre is a Constitutional Court judgment that clarified what a “month” means in South African law. Applying that definition, it becomes clear that the extensions of the National State of Disaster (NSD) after 14 June 2020 were incorrectly calculated and therefore invalid.
The Applicants now seek:
- A declaration that the NSD legally ended on 14 June 2020.
- A finding that every extension beyond this date was unconstitutional and of no force.
- Orders to set aside all regulations, enforcement actions, and mandates premised on those unlawful extensions.
- Certification of a class action allowing South Africans to claim damages, or alternatively, a special compensation fund to be established within 60 days.
Why This Matters
- Novel Ground: Never before has a court been asked to apply the Constitutional Court’s definition of “month” to disaster extensions — a technical but decisive point.
- Vaccine Fallout: SAHPRA has since deregistered 3 out of 4 COVID-19 vaccines, despite them being aggressively promoted and, in many cases, coerced under unlawful mandates.
- Human Cost: Over 300 individuals have already come forward through LFN, reporting dismissals, demotions, or business collapses. Thousands more may join once class action procedures are certified.
- Billions in Play: If the Court rules in LFN’s favour, the State could face claims amounting to billions of rand.
LFN’s Position
De Beer said:
“We warned South Africa in 2020 that the lockdown regulations were unconstitutional — and the High Court agreed. Today, with new evidence, new arguments, and the Constitutional Court’s own guidance on what a month in law means, we are showing that every extension of the State of Disaster was unlawful. South Africans who suffered under this unlawful regime now deserve justice and compensation.”
Background
- NSD declared: 15 March 2020.
- Lapsed: 14 June 2020 by operation of law.
- Government nonetheless extended it by incorrectly fixing dates rather than applying the legal definition of “one month” correctly.
- LFN formally warned Minister Hlabisa on 7 August 2025, but after no reply was received, the case was filed under Case No. 2025-149813.
The Stakes
This litigation is expected to become one of the most consequential constitutional matters in South Africa’s history. It will not only determine the validity of past government conduct but may also set the standard for future limits on executive power in times of national crisis.
